16. Dispute Resolution; Arbitration; Class-Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by JAMS under its applicable rules, conducted in New York County, New York, in English. You and AWSM Times waive any right to a jury trial. YOU AND AWSM TIMES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights. If the class-action waiver is found unenforceable, then the entirety of this Section 16 shall be null and void, but the rest of these Terms shall remain in effect.
17. Modifications to the Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting updated Terms with a revised Effective Date. Your continued use of the Site after such changes constitutes acceptance of the revised Terms.
18. Severability; Entire Agreement; Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and AWSM Times regarding the Site. Failure to enforce any provision shall not be deemed a waiver of that or any other provision.
